By accessing or using Heardsafe ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Heardsafe is operated by HeardSafe LLC ("we," "us," or "our").

2. Description of Service

Heardsafe is a confidential digital platform that allows workers to document workplace safety concerns, incidents, and related information. The Service includes:

  • A secure web application for incident documentation
  • A voice-based reporting system via telephone
  • AI-assisted documentation tools
  • Resource articles and educational materials

3. User Accounts

Registration: To use the Service, you must create an account by providing accurate and complete information, including your name, personal email address, personal phone number, and employer information.

Personal Contact Information: You must use personal (non-corporate) email and phone numbers. Do not use employer-provided devices or contact details to access the Service.

Account Security: You are responsible for maintaining the confidentiality of your PIN and account credentials. Notify us immediately of any unauthorized use of your account.

4. Privacy and Confidentiality

Your privacy is fundamental to our Service. We are committed to:

  • Encrypting your personal data and incident reports
  • Never sharing your identity or reports with your employer without your explicit written consent
  • Maintaining strict confidentiality of all documented incidents
  • Providing you full control over your data

5. Acceptable Use

You agree to use the Service only for its intended purpose: documenting legitimate workplace safety concerns and incidents. You agree not to:

  • Submit knowingly false or fabricated reports
  • Use the Service to harass, defame, or threaten any individual
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use automated tools to scrape or extract data from the Service
  • Reverse engineer, decompile, or disassemble any part of the Service

6. Important Disclaimers

Heardsafe is not a law firm and does not provide legal advice. The Service is a documentation tool. Information provided through the Service, including resource articles, should not be considered legal counsel. If you need legal advice regarding a workplace issue, consult a qualified attorney.

Heardsafe is not a substitute for:

  • Filing an official complaint with OSHA or your state's workplace safety agency
  • Reporting an emergency to 911 or appropriate emergency services
  • Seeking legal representation for workplace disputes
  • Reporting workplace injuries to your employer as required by law

7. Data Ownership

You retain ownership of all content you submit to the Service, including incident reports, notes, and documentation. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

8. Service Availability

We strive to maintain 24/7 availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or unforeseen circumstances. We are not liable for any damages resulting from Service unavailability.

9. Termination

You may delete your account at any time. Upon account deletion, we will remove your personal information in accordance with our Privacy Policy. We reserve the right to suspend or terminate accounts that violate these Terms.

10. Limitation of Liability

To the maximum extent permitted by law, Heardsafe and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the preceding 12 months.

11. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles.
